Jason Cerbone (Cerbone) files this Verified Motion to Request that Judge Tammy Stokes Recuse herself from this Case, because according to Bo Bowen (Bowen), Judge Stokes is one of his best friends. Bowen has told me this many times in the year and a half that I have known him. 

I will never forget the first time that he told me that Judge Stokes was his good friend. I was sitting in his office talking to him about a case that I had which Judge Chris Middleton was given. I explained that Middleton was a good friend. Bowen said he saw my Allen Iverson picture that I hung on my office wall. Bowen said he had played Allen Iverson in a game of pick-up basketball when he was at Georgetown Law School, and he won. Bowen said he would always beat his law school teammates.  Bowen said, “We won, I don’t remember what happened,….but we won.” Bowen then said that Chris Middleton would probably recuse himself from my case. Then Bowen told me how he was close to Judge Tammy Stokes. 

Other members of the community have also told me that Bo Bowen is tight with Judge Tammy Stokes. Even a local Judge sent me a text message which said Bowen was tight with Judge Tammy Stokes.

Obviously, all this gives the appearance of impropriety. Under the Georgia Code of Judicial Conduct, Canon 2 states that “Judges Shall Avoid Impropriety and the Appearance of Impropriety in All of Their Activities.

Judge Chris Middleton recused himself from the case I spoke to Bowen about, because he is my friend. Judge Sapp has recused himself from all cases with me because he had a law practice with my father. He is allowed to hear my cases, But he chooses not to because of the appearance of impropriety.

Therefore, I ask that Judge Tammy Stokes Recuse herself from my case because her relationship with Bo Bowen gives the appearance of impropriety.
