My client was pulled over by the Georgia Department of Public Safety (aka Georgia State Patrol) on I-16 leaving Savannah, Georgia at 2:15 am. He was pulled over for failure to maintain his lane a couple of times. He told the police officer that he had three Miller Lites earlier in the night. The cop did the three Field Sobriety Tests: Horizontal Gaze Nystagmus (eye test), Walk and Turn, and the One Leg Stand.
My client refused the Preliminary breath test on the side of the road. He was arrested for DUI less safe. My client also refused any chemical testing.
In the end we were able to keep his license from being suspended and he got his Chatham County DUI charge reduced to Reckless driving. That’s a win.
