There are various ways to beat a DUI charge. Georgia’s breath test can give wrong high readings because of many things. We find and attack the weaknesses in the government’s case against you. If anything is out of order, we’ll find it. First, we do an investigation into your DUI arrest. Often, the evidence against you is misleading, incomplete, or poorly collected. We fight to suppress that evidence so the state cannot use it at trial. Suppressing the evidence often results in dismissing the DUI charges.
We have the mind-set that every case will go to trial, but this does not mean that we do not ever plea-bargain. When we do deal, the best deals come on the first day of trial right before selecting a jury, or the night before.
We visit the scene of your DUI arrest. We use photos and videos to bring out the truth. Photos can be used in court to prove that you were not under the influence at the time of your DUI arrest. We use video to recreate the route you drove on the night of the arrest. You probably took some field sobriety tests. You also probably “failed” them according to the police officer. You might want to show the court where you took the field sobriety tests. If the ground was not level, then the officer invalidated the Walk and Turn and the One Leg Stand field sobriety tests. We must prove that you were not under the influence.
Roadside tests must be administered according to the Field Sobriety Training Manual. If the tests are done differently by the police officer, he may have invalidated them. If so, it is possible to keep the tests out of evidence in your DUI case. We use the “Manual” to try and beat your DUI charges. If the tests are done wrong then you will probably need the help of an expert witness, like a former DUI Field Sobriety Training Instructor. This enables you to present their expert opinion to the court.
